Affiliate and Referral Terms

Program Scope

These Terms govern any referral or affiliate program operated by MartGain that provides partners with links, codes, or tracking methods in exchange for commission on qualifying orders.

Eligibility and Acceptance

Depending on the program stage, enrollment may be open or subject to prior approval. MartGain may reject or suspend a partner account if its promotional practices do not comply with these Terms, MartGain’s brand identity, or applicable laws.

How Are Referrals Attributed?

When a user visits the MartGain website through a valid referral link, we may store the referral code in their browser for 30 days. Unless we announce a different rule for a specific campaign, MartGain attributes the first valid referral within that period. If the period expires before purchase, commission does not automatically become payable.

What Is a Qualifying Order?

A qualifying order is a genuine purchase that has been paid for and accepted and has not been canceled, refunded, or identified as fraudulent. Certain products, services, or offers may be excluded from commission if clearly stated in the program or offer terms.

Commission Calculation

Commission is calculated using the rate or amount published in the referral program when you join or at the time of the campaign. It may be calculated on the qualifying net order value after discounts, refunds, chargebacks, and any excluded items specified by the program.

When Does Commission Become Payable?

Commission remains pending until payment is settled and any reasonable refund or dispute review period has ended. If an order is refunded in full or in part, canceled, or found to be invalid, the related commission will be canceled or adjusted.

Payouts

Under the current version, commissions are reconciled and paid manually according to the schedule, payment method, and minimum threshold, if any, published on the referral program page or in the individual partner agreement. The partner is responsible for providing accurate payment details and meeting any applicable tax or regulatory obligations.

Self-Referrals

You may not create a referral to earn commission on your own purchases, purchases by an entity you control, or a sham order arranged to generate commission. Commission may be canceled and the account suspended if self-referrals or similar manipulation are detected.

Prohibited Promotional Methods

• Spam via email, messages, comments, or groups without appropriate consent.
• False information, exaggeration, or promises of results not announced by MartGain.
• Impersonating MartGain or claiming to be an employee or official representative without permission.
• Using a domain, social media account, or visual identity that misleads users into believing it is the official website.
• Purchasing ads targeting the MartGain brand name or misspellings to divert customers, unless we obtain your written consent.
• Cookie stuffing, forced redirects, or any method that records a referral without genuine user action.
• Offering unauthorized coupons or publishing private codes on coupon websites in violation of campaign terms.
• Promoting through unlawful or fraudulent content or content that infringes third-party rights.

Transparency With Your Audience

When a link is commercial or you will earn a commission, you must disclose your referral relationship appropriately and clearly under the platform’s rules and applicable law. You may not conceal the nature of the relationship where disclosure is required.

Use of the MartGain Name and Logo

You may use materials and links we provide for the program for their intended purpose. The program does not give you ownership of the MartGain trademark or the right to modify or register it, or to use a design that misleads users into believing your website or page is officially affiliated with us.

Refunds and Disputes

If an order is refunded, a payment reversed, or a violation or fraud established, no commission is due. If commission has already been paid on a transaction that is later reversed, the amount may be deducted from a future payout or reasonably recovered through settlement.

Data and Privacy

You must not collect or use users’ data in MartGain’s name without a clear legal basis. Referral data made available by the program is used to measure orders and commissions and does not entitle a partner to access personal data unnecessary for their role.

Suspension and Termination

A partner’s participation may be suspended or terminated for fraud, manipulation, spam, impersonation, breach of these Terms, intentional harm to the brand, or a clear legal or security risk. Valid commissions earned before termination remain subject to the usual review unless they are connected to the violation.

Program Changes

We may change commission rates, eligible products, or tracking methods, or terminate the program. Changes apply to future referrals after an appropriate announcement or notice, and we will not recalculate a properly earned commission on an earlier order except in cases of error, fraud, or refund.
