01Who we are and what this policy covers

This Privacy Policy explains how MartGain (“MartGain”, “we”, “us”) collects, uses, shares, stores, and protects personal information when you:

• visit martgain.net or send us a request through the contact form or WhatsApp;
• create or use an account on the MartGain platform and web application; or
• connect a social media account, such as TikTok, and use MartGain to prepare and publish content.

MartGain is responsible for the personal information described in this policy. For questions, contact info@martgain.net. This policy should be read together with our Terms of Service.

02Information we collect

a) Website contact form and WhatsApp inquiries

• When you send the growth request form, MartGain receives the details you choose to submit: name, phone or WhatsApp number, business type, message, website or social link, preferred contact method, and any optional fields.
• If you contact us on WhatsApp or by email, we receive your number or address and the messages you send.

b) MartGain account information

• Name, email address, company or brand name, role, and login details for you and any team members you invite.
• Workspace settings, preferences, support messages, and, for paid plans, billing contact details. We do not store full payment card numbers.

c) Information from TikTok when you connect your account

When you choose to connect TikTok, you are sent to TikTok’s official login and authorization screen. With your permission, TikTok shares the following with MartGain:

We only request the permissions needed for these features. We do not receive your TikTok password, your private messages, your followers’ data, or your contacts, and we do not access other TikTok users’ data.

d) Content you publish

The videos, photos, thumbnails, titles, captions, hashtags, mentions, and the settings you select (privacy level, comments, Duet, Stitch, and commercial content disclosure) for each post, plus any scheduled date and time.

e) Technical and usage information

IP address, browser and device type, operating system, pages and features used, timestamps, error logs, and security or sign-in events. Our website uses Google Tag Manager, and may use analytics and advertising cookies, to understand visits and measure our own marketing. You can control cookies in your browser settings.

03How we use information

• To answer your inquiry, review your business context, understand your current marketing blockage, and continue the conversation through WhatsApp, email, or the contact method you use.
• To create and run your MartGain account and workspace.
• To connect your social media accounts and show which account you are publishing to.
• To display the publishing options your account allows, generate previews, and carry out the publishing or scheduling instructions you give.
• To show you processing and publishing status.
• To provide support, fix problems, keep the Service secure, and prevent misuse.
• To meet legal obligations and enforce our Terms.

We use your information only for these purposes, or for a compatible purpose that we explain to you first.

04Our commitments for TikTok data

• We do not sell TikTok data or access tokens, and we do not share them with advertisers or data brokers.
• We do not use TikTok data for advertising, for profiling, or to build profiles of TikTok users.
• We do not use TikTok data or your TikTok content to train artificial intelligence or machine learning models.
• We do not post, edit, or delete anything on your TikTok account without your explicit instruction.
• We do not add watermarks, logos, or promotional material to content you publish.
• Access tokens are encrypted, stored on secured servers, and available only to the systems that need them to carry out your requests.
• When you disconnect TikTok, we stop using your tokens right away and delete them as described in section 9.

TikTok processes the content you publish under its own Privacy Policy.

05Legal bases for processing

Where data protection laws require a legal basis, such as the GDPR or the privacy laws of Egypt, Saudi Arabia, or the UAE, we rely on:

• Contract: to provide the Service you signed up for and the publishing actions you request;
• Consent: when you connect a social media account and authorize specific permissions, and for non-essential cookies where required. You can withdraw consent at any time;
• Legitimate interests: to respond to inquiries, secure the Service, and improve it, in ways you would reasonably expect;
• Legal obligation: where the law requires us to keep or disclose information.

06When we share information

We do not sell personal information. We share it only in these situations:

• With the platform you publish to. When you tell us to publish to TikTok, we send the selected content and settings to TikTok through its official API.
• With service providers who host, store, secure, and support the Service (for example cloud hosting, file storage, email, and analytics providers). They process information only on our instructions and under confidentiality obligations. Data received from TikTok is shared with them only as strictly needed to run the Service.
• With your team. Members of your MartGain workspace can see the content and connected accounts you share in that workspace.
• For legal reasons. Where required by law, a court, or a public authority, or to protect the rights, safety, or security of users, MartGain, or the public.
• In a business transfer, such as a merger or acquisition. The information would remain protected by this policy.

07AI-assisted features

Some MartGain features can help draft captions or ideas using third-party AI providers. These features run only when you use them, and only on the text or files you choose to submit. We do not send data received from TikTok’s APIs to AI providers, and we do not allow any of your data to be used to train their models where we can control that setting.

08How we protect information

• Encryption in transit (HTTPS/TLS) across the website and platform.
• Access tokens encrypted at rest.
• Access limited to the people and systems that need it.
• Monitoring and logging to detect misuse.

No system can be guaranteed to be completely secure. If a security incident affects your information, we will notify you and the relevant authorities when the law requires it.

09How long we keep information

We may keep limited information for longer only where the law requires it.

10Your choices and rights

Depending on where you live, you may have the right to access, correct, delete, restrict, or object to the processing of your personal information, to receive a copy of it, and to withdraw your consent. You can also complain to your local data protection authority.

Disconnecting TikTok

• In MartGain: open your account settings, go to connected accounts, and disconnect TikTok.
• In TikTok: open the TikTok app settings and remove MartGain from the apps that have access to your account.

Either way, MartGain can no longer publish to your account and your tokens are deleted as described above.

11Requesting deletion of your data

To delete your MartGain account, or any data we hold about you (including data received from TikTok and any inquiry you sent through the website), email info@martgain.net with the subject “Data Deletion Request”, or message our official WhatsApp number.

We may ask you to confirm your identity so that no one else can delete your data. We will confirm receipt and complete valid requests within 30 days. Deleting data from MartGain does not delete posts already published on TikTok. You can delete those in the TikTok app.

12Please don’t send us sensitive data

• MartGain does not ask for sensitive medical, payment, password, or private customer data through the website form or WhatsApp.
• Do not submit patient records, private customer lists, passwords, financial account details, or confidential internal data through the public form.

13International transfers

MartGain works with clients in Egypt, Saudi Arabia, Iraq, the UAE, and Oman, and uses service providers that may process information in other countries. When information is transferred across borders, we use appropriate safeguards required by applicable law.

14Children

The Service is intended for adults and businesses. It is not directed to anyone under 18, and we do not knowingly collect their personal information. If you believe a minor has given us personal information, contact us and we will delete it.

15Changes to this policy

We may update this policy when our Service, integrations, or legal requirements change. We will update the “Last updated” date above and, for material changes, notify account holders before the changes take effect.
